Tuwaiqna Terms of Use Agreement
Introduction This Terms of Use Agreement, along with the Privacy Policy, terms, and conditions, and all policies published on the Tuwaiqna Platform are set forth to protect the rights of both Tuwaiqna Information Technology Establishment (the entity operating the Tuwaiqna Platform) and the user accessing the site, whether registered or unregistered, and the consumer benefiting from the content, whether registered or unregistered.
The terms, conditions, and legal disputes are subject to the laws, regulations, and legislation in force in the Kingdom of Saudi Arabia.
By using or accessing the Tuwaiqna Platform, or by registering for any service, you agree to comply with all the provisions set forth in this agreement. Tuwaiqna Platform reserves the right to amend these terms at any time. All changes are binding upon publication on the site or through any other communication means.
Article 1: Definitions
Tuwaiqna Platform: An electronic platform allowing users to create accounts and publish content in accordance with applicable laws and regulations. It is operated by Tuwaiqna Information Technology Establishment, referred to in this agreement as “we,” “us,” “our,” “the platform,” or “the first party.”
User: Any individual who creates an account on the Tuwaiqna Platform to browse, communicate, publish content, or create an online store as a service provider engaged in e-commerce. The user is referred to as “member,” “practitioner,” “service provider,” or “the second party.”
Online Store: The digital account enabling users to display, sell, or advertise a product or service, or exchange related data.
Article 2: Terms of Use As the second party and a beneficiary of the Tuwaiqna Platform services, you must adhere to the following:
Do not publish or upload inappropriate content outside the allowed categories. Review the prohibited items policy before posting.
Do not breach or circumvent platform policies or infringe on third-party rights.
Do not copy advertisements from Tuwaiqna and repost them elsewhere.
Do not use unauthorized methods to access ads, user data, or platform content, or to collect or reuse Tuwaiqna’s information.
Do not use our services if you are legally ineligible to enter into this agreement.
Do not manipulate product prices to harm other consumers.
Do not include misleading claims or defamatory content in your posts.
Do not target political figures, states, or engage in unlawful discussions related to the platform.
Do not move your activity to another site while still using Tuwaiqna’s branding.
Do not violate Tuwaiqna’s intellectual property rights, including copyrights, trademarks, patents, and databases.
Do not use unauthorized or counterfeit logos or trademarks.
Do not advertise tobacco or smoking-related products.
Do not violate human rights laws or advertise labor services without proper compliance.
Adhere to real estate advertisement regulations as set by the General Real Estate Authority.
Obtain a license from the Ministry of Tourism for offering tourism-related products.
Comply with wildlife protection licenses from the National Center.
Do not collect or use users’ personal data or communication for unauthorized purposes.
Obtain licensing from the Saudi Council of Engineers when required.
Do not defame or damage the reputation of Tuwaiqna in any medium.
Do not impersonate Tuwaiqna or any of its representatives.
The use of the service by non-human users is prohibited, except for systems operated by Google, Facebook, and Twitter.
Non-compliance grants Tuwaiqna the right to suspend your account, blacklist your phone number, and report you to legal authorities without prior notice or liability.
Article 3: Liability Tuwaiqna provides a platform for users to display and offer their content or items in accordance with usage policies. The platform does not guarantee results and is not responsible for user or consumer misconduct. Tuwaiqna bears no responsibility for damages, risks, or consequences resulting from transactions between users. Affected parties must submit complaints through the contact page, and the platform will act accordingly without assuming liability. By using the platform, you acknowledge that you are solely responsible for complying with applicable laws, handling transactions, delivery, disputes, and ad content. Tuwaiqna may review private messages if necessary and delete posts or images violating its policies. Instructions from the platform’s administrators or supervisors are binding once delivered via site messages, mobile, email, or notifications. Tuwaiqna reserves the right to seek legal compensation, including attorney fees, for violations causing damages or losses.
Article 4: Membership Conditions Membership refers to the user’s account linked to their mobile number. The following conditions apply:
Choose an appropriate username.
Do not create multiple accounts for the same person or entity.
Update your mobile number if changed or lost.
If using a business or trademark name, you must own or be authorized to use it.
Do not sell or transfer your account.
Do not share your account credentials.
Tuwaiqna takes appropriate measures to secure your data, but full internet security cannot be guaranteed (refer to the Privacy Policy).
The platform may exchange information with your device to deliver services.
The platform uses analytics tools (e.g., Google Analytics) for service improvement.
Accounts may be suspended for violations, and you agree not to disclose incidents publicly. Tuwaiqna may pursue legal action if this occurs.
Article 5: Content Submission Rules
Do not post or promote banned items.
Avoid prohibited replies or messages.
Specify item prices clearly.
Respond to customer inquiries.
Do not post duplicate ads.
Content must relate to a product or service.
Provide complete details in the correct category.
The platform may remove any content without explanation.
Do not copy content from other listings.
Obtain all necessary licenses for regulated services or products.
Uploaded images must match the actual item.
Images must be appropriate and high-quality.
Limit to 5 active listings per item.
Follow all prohibited content rules.
Do not post on behalf of others without knowing them.
You are solely responsible for the accuracy and legality of your content.
Update your listing regularly; otherwise, it may be removed automatically.
Article 6: Labor Services Advertisement Rules
Only licensed recruitment offices may advertise labor services.
Do not use degrading language like “for sale”; use “transfer of service” instead.
Replace terms like “maid” with “worker.”
Workers must not bear any service transfer costs.
Do not publish personal documents or photos of workers.
Do not indicate any monetary exchange for worker transfers.
Always obtain the worker’s consent before transferring their service.
Article 7: Prohibited Items
Any item banned under Saudi law.
Installment and financial products, even if compliant.
Medications, health-related products.
Network marketing (MLM) of any type.
Weapons, including licensed ones.
Adult content/products.
Stocks, currencies, financial services.
Spy devices, lasers.
Digital services, email accounts, memberships.
Free items (e.g., free accounts).
Pirated software or media.
Tobacco products.
Unlicensed services.
Devices with national security risk.
Telecom services or SIMs without licensing.
Data collection and sales in violation of data protection laws.
Article 8: Prohibited Advertisements
Non-commercial ads (e.g., suggestions, complaints).
Incomplete, misleading, or low-quality ads.
Posting in incorrect categories.
Duplicate or banned user listings.
Ads using others’ photos.
Defamatory or offensive content.
General or vague listings (e.g., “we have land”).
Donation or charity requests.
Begging or assistance requests.
Ads exploiting authority.
Ads placed in replies.
Article 9: Prohibited Replies
Ads in reply sections.
Price manipulation or lowballing.
Insults, jokes, or unserious comments.
Article 10: Prohibited Private Messages
Advertising in messages.
Insulting or abusive language.
Article 11: Subscription Terms
Read the terms before paying.
Subscription may be restricted if terms are violated.
Refunds only within 3 days of payment.
Article 12: Payment and Transactions
Conduct transactions face-to-face in public.
Verify identities and inspect products.
Use secure payment methods.
Tuwaiqna is not liable for fraud. Report violations through the platform and seek legal action when necessary.
