Introduction

This User Agreement, Privacy Policy, Terms and Conditions, and all policies published on the Our Tuwaiq Platform are intended to protect and preserve the rights of both Our Tuwaiq Company and every user who accesses the platform, whether registered or unregistered, as well as every consumer who benefits from its content, whether registered or unregistered.

These terms, conditions, provisions, and any legal disputes are governed by the laws, regulations, and rules applicable in the Kingdom of Saudi Arabia.

By using or accessing the Our Tuwaiq Platform, you agree to comply with all the terms of this agreement upon using the platform, registering for the service, or accessing it. Our Tuwaiq reserves the right to amend this agreement at any time, and any amendments shall become binding on all parties once announced on the website or through any other official communication method.

Article 1: Definitions

Our Tuwaiq Platform:
An online platform that enables users to create an account for publishing content in accordance with applicable laws and regulations. Its headquarters are in Jeddah. Throughout this agreement, it may be referred to as Our Tuwaiq Company (the owner of the Our Tuwaiq Platform), “we,” “us,” “the Website,” “the Platform,” or “the First Party.”

The User:
The individual who creates an account on the Our Tuwaiq Platform for communication, browsing, publishing content, or creating an online store as a service provider to conduct e-commerce activities on the platform. The user may also be referred to in this agreement as the member, practitioner, service provider, or the Second Party.

Online Store:
An online store that allows a user to display, sell, offer, advertise, or exchange information relating to a product or service.

Article 2: Terms of Use

As the Second Party to this agreement and a user of the Our Tuwaiq Platform, you agree to comply with the following:

• • Do not advertise or upload content or items that are not appropriate for the available categories on the platform or are not permitted for sale. Please review the advertising terms and prohibited goods before posting an advertisement.
  • Do not attempt to hack, bypass, or violate the platform’s rules, policies, regulations, or the rights of any third party.
  • Do not copy advertisements from the Our Tuwaiq Platform and republish them on other websites.
  • Do not use unlawful methods to access advertisements or other users’ data, violate the rights or policies of Our Tuwaiq Company, access the platform’s content without authorization, or collect, store, or republish any information or data relating to the platform or its users.
  • Do not use our services if you are not legally authorized to enter into this agreement.
  • Do not manipulate the prices of products or services, whether buying or selling, or engage in activities that may harm other consumers.
  • Advertisements must not contain false offers, misleading statements, deceptive claims, defamatory content, or anything intended to mislead consumers directly or indirectly.
  • Discussions relating to politics, international sovereignty, public figures, or any unlawful topics are prohibited on the Our Tuwaiq Platform.
  • Do not transfer your account or business activity to other websites while displaying the platform’s branding, logo, or services.
  • Do not infringe upon the intellectual property rights of Our Tuwaiq Company, including copyrights, trademarks, patents, publicity rights, databases, or any other intellectual property owned or licensed by the company.
  • Advertisements must not include any logo or trademark that you are not legally authorized to use, including counterfeit trademarks or content that infringes upon the intellectual property rights or patents of others.
  • Advertising tobacco or cigarette products is strictly prohibited. Violations may result in penalties imposed by the relevant authorities.
  • Do not violate human rights laws or engage in any form of human trafficking, and ensure compliance with the regulations governing the advertisement of labor services.
  • Comply with the real estate advertising regulations issued by the General Authority for Real Estate.
  • Obtain the necessary license from the Ministry of Tourism before offering any tourism-related products or services.
  • Comply with all regulations and licensing requirements issued by the National Center for Wildlife Protection.
  • Obtain all required licenses for water efficiency and conservation activities and comply with the regulations, controls, and standards issued by the National Center for Water Efficiency and Conservation.
  • Do not collect, use, disclose, or share the personal data or electronic communications of platform users for unauthorized purposes, whether for compensation or otherwise, unless you have obtained the data subject’s consent or are legally required to do so.

• • • Obtain the required license from the Saudi Council of Engineers for services or offers governed by the Council’s regulations.

• Do not engage in any activity that may damage the reputation of Our Tuwaiq Company, whether on the platform or through other social media platforms. The company reserves the right to seek compensation for any resulting damages.
• Do not impersonate Our Tuwaiq Company, its representatives, employees, or any affiliated entity unless you have received official authorization from the company.
• Use of this service by non-human users is prohibited, except for authorized non-human users belonging to the following companies:
  • Google
  • Facebook
  • Instagram
  • Snapchat
  • Tik Tok
  • X

Failure to comply with these Terms of Use grants Our Tuwaiq Company the right to suspend or terminate your membership, report your violations to the relevant authorities where necessary, prevent you from accessing the platform, and add your phone number to the list of suspended accounts and numbers without liability or prior notice. You waive any right to object to such actions and agree not to attempt to use the platform again unless your access is reinstated with the platform’s approval.

Article Three: Responsibility

Our Tuwaiq Company provides a platform that enables users to display their products and publish content in accordance with the agreed usage policies. The company does not provide any guarantees and assumes no responsibility if a user or consumer fails to comply with these policies.

The Our Tuwaiq Platform disclaims all responsibility for any risks, damages, consequences, or losses incurred by the seller, buyer, or any other party. Anyone who believes they have suffered damages should contact us through the Contact Us page and explain the nature of the damages. The company will review the matter and take appropriate action based on the type of incident, without assuming liability.

By using the Our Tuwaiq Platform, you acknowledge and accept full responsibility for complying with all applicable laws, regulations, and rules governing the use of the platform. You are also responsible for managing all purchases and deliveries if your account operates as an online store, as well as resolving any disputes or issues arising from your advertisements or their content. Furthermore, you agree to follow the platform’s content guidelines and Terms of Use and accept full responsibility for any consequences or damages resulting from the content you publish. Our Tuwaiq shall not be held liable for any claims arising from or related to your transactions.

By using the Our Tuwaiq Platform, you authorize the platform to store the personal and non-personal information you provide on the company’s servers. You also acknowledge that the company has the right to access and review such information when necessary.

By using the Our Tuwaiq Platform, you acknowledge the platform’s right to monitor private messages when necessary to ensure compliance with these Terms of Use. The platform also reserves the right to remove advertisements and delete any attached images whenever required.

All circulars, decisions, instructions, and directives issued by the platform’s management or moderators shall become binding upon the Second Party once communicated through platform messages, mobile phone, email, or the notification system. Users are required to comply with and act in accordance with such communications.

By using the platform, you acknowledge that Our Tuwaiq Platform has the right to seek compensation from you for any damages or losses resulting from your violation of the laws and regulations of the Kingdom of Saudi Arabia or the policies and regulations of the platform. Our Tuwaiq Company also reserves the right to recover legal expenses and any related costs incurred as a result of your violations, and you agree to compensate the company accordingly.

The user acknowledges that all reviews, whether positive or negative, are publicly visible and represent the opinions of customers. The platform is not responsible for the content of these reviews and is under no obligation to delete or modify any comment or review upon a user’s request. Users are solely responsible for the reviews and comments they publish and are responsible for editing or deleting them when necessary, without any obligation on the part of the platform.

Article Four: Store Terms

A Store refers to the username registered on the Our Tuwaiq Platform, which is linked to the user’s mobile number. The following conditions apply:

• A suitable and appropriate username must be selected during the registration process.
• Creating more than one account for the same user on the platform is prohibited.
• Individuals or entities are not permitted to operate more than one store on the platform.
• You must update the mobile number linked to your store if your number changes or is lost.
• If your username includes a trade name or trademark, you must be the legal owner of that trademark or have authorization to use it.
• Selling, transferring, or allowing another person to use your store is prohibited. The original owner remains fully responsible for any violations or legal liabilities arising from the account. Both parties involved in the sale or transfer shall be considered in violation of the Our Tuwaiq Platform’s Terms of Use.
• Members agree not to share their account credentials or membership information with anyone.
• Our Tuwaiq Platform is committed to implementing reasonable measures to protect and safeguard user data. However, users acknowledge that the internet cannot guarantee 100% security for confidential information. (Please refer to the Privacy Policy.)
• The platform exchanges certain information with your device as necessary to provide its services.
• The platform uses analytical tools, such as Google Analytics, to improve and enhance its services.
• By using the Our Tuwaiq Platform, you acknowledge the platform’s right to suspend your account or phone number and add it to the list of suspended accounts if a complaint is filed against you or if you commit a violation that the platform’s management considers to warrant suspension. You also agree not to publish or disclose such incidents on electronic platforms, social media, or other public channels. If such disclosure is proven, the platform reserves the right to refer the matter to the competent authorities, seek applicable penalties or fines, and claim compensation for any resulting damages or losses.

Article Five: Conditions for Adding Content to the Platform

• You agree not to advertise any prohibited goods on the platform.
• You agree not to post any prohibited replies on the platform.
• You agree not to send any prohibited private messages through the platform.
• You are responsible for clearly specifying the selling price of the advertised item.
• You agree to monitor your advertisements and respond to customer inquiries through replies or private messages.
• You agree to comply with the platform’s policy regarding duplicate advertisements.
• The advertised content must relate only to a product or service.
• Advertisements must contain complete and accurate details and be published in the appropriate category.
• Our Tuwaiq Platform reserves the right to remove any advertisement or content without providing a reason.
• Copying advertisements from the platform is strictly prohibited.
• You must obtain all required licenses before advertising. If you provide a service, sell a product, or practice a regulated profession that requires a license or permit, you must clearly disclose the licensing authority, the license or permit details, your professional title, and the country that issued the license.
• The advertiser is responsible for ensuring that all images uploaded accurately represent the advertised item.
• Images included in advertisements must be appropriate, of good quality, and must not violate the regulations of the Ministry of Human Resources, human rights laws, or the regulations of any governmental or private authority.
• Advertisers may not publish more than five advertisements for the same item on the platform.
• You must refrain from advertising any goods or services listed as prohibited and comply with the lists of prohibited replies and prohibited private messages.
• You agree not to advertise on behalf of, or register an account for, anyone you do not personally know.
• Any updates or modifications made to an advertisement remain subject to all the terms and conditions of this agreement, and the user remains responsible for any violations that occur before or after such modifications.
• Creating, updating, and modifying advertisements is solely the responsibility of the user.
• Advertisers are responsible for keeping their advertisements up to date. Advertisements that are not updated may be removed automatically.

Article Six: Regulations for Advertising Labor Services

• To advertise labor services, you must be a licensed recruitment office authorized to conduct this activity.
• Advertisements must not include words or phrases that undermine the dignity of expatriate workers, domestic workers, or similar categories. Expressions such as “for sale,” “for purchase,” or “for transfer” must be replaced with appropriate wording such as “transfer of services.”
• Advertisements must not use the terms “servant” or “maid” and should instead use the term “worker.”
• Advertisements must never include charging the worker any fees related to the transfer of services.
• Advertisements must not publish personal photographs, identity cards, residence permits, passports, or any other personal information relating to expatriate or domestic workers.
• Advertisements must not imply, under any circumstances, that the advertiser, service provider, or any related party has received financial compensation for transferring a worker’s services.
• The worker’s consent must be obtained before transferring their services.

Article Seven: Prohibited Goods

Users who advertise prohibited goods on the Our Tuwaiq Platform will have their accounts permanently suspended. Buying, selling, or advertising these goods is strictly prohibited. Users who interact with such advertisements through replies or private messages may also be suspended. Please note that suspensions are issued without prior warning and are final.

Prohibited Goods

• Any goods prohibited under the laws and regulations of the Kingdom of Saudi Arabia.
• Installment financing schemes and banking products, even if considered legally permissible.
• Medicines, medical products, and healthcare supplies, even if approved or recommended by the Ministry of Health.
• Network marketing of any kind, regardless of its structure or method.
• Weapons, including stun guns, pistols, machine guns, personal protection weapons, and all related accessories, even if licensed.
• Sexual products of any type.
• Stocks, investment portfolio management, currencies, financial trading, marketing of financial products, and related services.
• Laser devices and surveillance, spying, or eavesdropping equipment.
• Websites, forums, electronic services, email accounts, memberships, and software for sale.
• Selling items that are originally provided free of charge, such as email accounts or social media accounts.
• Products that violate intellectual property rights, including pirated software, copied digital content, and pirated movies.
• Tobacco products.
• Advertising products or services that require official licensing without obtaining the required license.
• Prohibited communication devices, including signal jammers, encryption devices, and mobile signal boosters.
• Devices that present security risks.
• Advertising SIM cards or telecommunications services without the required licenses or without uploading the required documentation to the platform’s licensing system.
• Collecting, trading, or selling personal data in violation of the Personal Data Protection Law.

Article Eight: Prohibited Responses

The following responses are prohibited on Our Tuwaiq Platform, and users who post them may be subject to suspension:

• Responses containing offensive language, insults, or defamatory remarks.
• Responses that include racism, discrimination, or hate speech.
• Responses intended to harass, threaten, or intimidate other users.
• Posting personal information about others without their consent, including phone numbers, addresses, or other private details.
• Responses containing false, misleading, or deceptive information.
• Promoting prohibited goods or services through replies.
• Posting links to external websites or platforms for advertising purposes without authorization.
• Repeating the same response multiple times (spam).
• Responses unrelated to the advertised item or intended to disrupt the advertisement.
• Attempts to negotiate or complete transactions involving prohibited goods or services.
• Any response that violates applicable laws and regulations in the Kingdom of Saudi Arabia.
• Any content that infringes upon intellectual property rights.
• Responses encouraging users to communicate outside the platform for fraudulent or prohibited purposes.
• Publishing advertisements or promotional content within another user’s advertisement.
• Impersonating another person or entity in replies.
• Any response deemed inappropriate or harmful by the management of Our Tuwaiq Platform.

Article Nine: Prohibited Private Messages

Users must not use the private messaging feature for any unlawful or prohibited activity. The following are strictly prohibited:

• Sending offensive, abusive, or threatening messages.
• Sending spam or repeated unsolicited messages.
• Promoting prohibited goods or services.
• Sending fraudulent, deceptive, or misleading messages.
• Requesting or sharing confidential personal or financial information without a legitimate reason.
• Using private messages to harass, intimidate, or blackmail others.
• Sharing malicious links, software, or files that may harm users or their devices.
• Conducting transactions involving prohibited goods or services.
• Impersonating another individual or organization.
• Using private messages for any activity that violates the laws of the Kingdom of Saudi Arabia or the policies of Our Tuwaiq Platform.

The platform reserves the right to review private messages when necessary to ensure compliance with these Terms of Use and may take appropriate action against violating accounts.

Article Ten: Violations and Penalties

Users are required to comply with all policies and regulations of Our Tuwaiq Platform. Violations may result in one or more of the following actions, depending on the nature and severity of the violation:

• Removing or editing advertisements or content that violate platform policies.
• Issuing warnings to users.
• Temporarily suspending the user’s account.
• Permanently suspending the user’s account.
• Restricting access to certain platform features.
• Reporting violations to the relevant authorities when required by applicable laws and regulations.
• Taking legal action to recover any damages or losses resulting from policy violations.
• Recovering any legal costs or expenses incurred due to the user’s violation of the platform’s policies or applicable laws.

The management of Our Tuwaiq Platform reserves the right to determine the appropriate action for each violation and may enforce these measures without prior notice where necessary.

Article Eleven: Intellectual Property Rights

All content published on Our Tuwaiq Platform, including but not limited to text, images, logos, graphics, designs, software, databases, and other materials, is protected under applicable intellectual property laws and regulations.

• Users may not copy, reproduce, distribute, publish, modify, or exploit any content from the platform without obtaining prior written permission from Our Tuwaiq Platform, unless otherwise permitted by applicable law.
• Users are solely responsible for ensuring that any content they upload or publish does not infringe upon the intellectual property rights of any third party.
• If a user believes that content published on the platform infringes their intellectual property rights, they should contact the platform through the designated communication channels and provide sufficient evidence supporting their claim.
• Our Tuwaiq Platform reserves the right to remove or restrict access to any content that may violate intellectual property rights without prior notice.

Article Twelve: Limitation of Liability

• Our Tuwaiq Platform provides an electronic marketplace that enables users to advertise goods and services in accordance with these Terms of Use.
• The platform acts solely as an intermediary between users and is not a party to any transaction conducted through the platform.
• Our Tuwaiq Platform does not guarantee the accuracy, quality, safety, legality, or availability of any goods, services, advertisements, or content published by users.
• Users are solely responsible for verifying all information before completing any transaction.
• The platform shall not be liable for any direct, indirect, incidental, consequential, or financial losses arising from the use of the platform or from transactions conducted between users.
• Users agree to indemnify and hold Our Tuwaiq Platform harmless from any claims, damages, liabilities, or expenses resulting from their use of the platform or their violation of these Terms of Use or applicable laws.

Article Thirteen: General Provisions

• These Terms of Use are governed by the laws and regulations of the Kingdom of Saudi Arabia.
• Any dispute arising from the use of Our Tuwaiq Platform shall be subject to the jurisdiction of the competent courts in the Kingdom of Saudi Arabia, unless otherwise required by applicable law.
• If any provision of these Terms of Use is found to be invalid or unenforceable, the remaining provisions shall continue to remain in full force and effect.
• Failure by Our Tuwaiq Platform to enforce any provision of these Terms of Use shall not constitute a waiver of its right to enforce that provision or any other provision at a later time.
• Our Tuwaiq Platform reserves the right to amend, update, or modify these Terms of Use at any time. Continued use of the platform after such amendments become effective constitutes acceptance of the updated Terms of Use.
• Users are responsible for reviewing these Terms of Use periodically to stay informed of any updates or changes.
